OverviewThe Arbitration Act allows employers to implement an alternative dispute resolution program that requires employers and employees to resolve any dispute under the Administrative Act through binding arbitration.
Arbitration may be used to resolve claims if:
- Employer’s medical plan has been approved by the WC Commission
- Notice is provided to employees and insurance carrier
- Employer’s alternative dispute resolution plan is filed with the WC Commission
- Agreement is subject to Federal Arbitration Act and decisions are appealable to the WC Commission
